01Introduction

These Terms for Guest Play ("Terms") govern access to and use of the TonUp™ game via the website tonup.games by users who play without creating an account ("Guest Users").

By accessing or playing TonUp™ as a guest, you agree to be bound by these Terms.

If you do not agree, you must not use the game.

02Ownership & Intellectual Property

TonUp™, including but not limited to:

  • Game rules and formats
  • Scoring system and mechanics
  • Board design and layout
  • Visual design, illustrations, and scorecards
  • Software logic and implementations
  • Branding, names, and terminology

is the exclusive intellectual property of TonUp™ Ltd. All rights are reserved unless expressly stated otherwise.

Nothing in these Terms grants you any ownership rights or licence beyond limited personal use.

03Permitted Use (Guest Licence)

Guest Users are granted a limited, non-exclusive, non-transferable, revocable licence to:

  • Play TonUp™ for personal, non-commercial entertainment
  • Use the game within a single browser session

This licence does NOT include the right to:

  • Copy, reproduce, or redistribute the game
  • Replicate the rules for commercial use
  • Create derivative games, boards, or apps
  • Record, scrape, or reverse engineer the software
  • Use TonUp™ in competitions, venues, or events without permission

04Session-Based Gameplay

Guest play is provided on a session-only basis.

  • Game data may be stored temporarily in-session
  • Progress may be lost on refresh, timeout, or browser closure
  • No guarantee is made regarding data persistence or recovery

The service is provided "as is" and "as available".

05Fair Use & Prohibited Conduct

You agree not to:

  • × Attempt to bypass game restrictions or scoring logic
  • × Exploit bugs or unintended behaviour
  • × Interfere with servers, APIs, or site security
  • × Use automated tools, bots, or scripts
  • × Misrepresent TonUp™ as your own creation

Any misuse may result in immediate termination of access.

06No Commercial Use

Guest play does not permit:

  • Use in pubs, clubs, leagues, or tournaments
  • Streaming or monetised broadcasts without consent
  • Paid coaching, training, or events

Commercial use requires a separate written licence.

07Availability & Changes

We reserve the right to:

  • Modify or discontinue guest play at any time
  • Update these Terms without notice
  • Restrict access for maintenance or security reasons

Continued use after changes constitutes acceptance of the updated Terms.

08Disclaimers & Limitation of Liability

TonUp™ is provided for entertainment purposes only.

To the fullest extent permitted by law:

  • We disclaim all warranties, express or implied
  • We are not liable for loss of data, scores, or progress
  • We are not liable for indirect or consequential damages

Nothing in these Terms limits liability where prohibited by law.

09Governing Law

These Terms are governed by the laws of England & Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
